    What about the money?
    Any proceeds from the court case will be donated to various privacy NGO's in Japan and America, minus legal fee's.

    I never worked for Soumushou
    Just to clarify, my work was never for Soumushou it was for Nagano.
    Below is an email I sent to a mailing list. Since my normal website is down its hard for people to follow exactly what has happened up to this point.

    Hi,

    Some background.

    My work for was Nagano Prefecture not Soumushou which is the national government. Nagano hired me to test their deployment of Juki. The purpose was to verify that the network was safe for its residents to use. I've never done any work with Soumushou.

    The results of my test lead Nagano to believe that the network was not safe for use, though they suspected it before my test. I have an NDA with Nagano that prevents me from discussing technical details of their network environment. However my report was made public by Nagano and was distributed widely to the media with my name omitted.

    In comes PacSec. Nagano had no objections to me discussing the results that were made public and identifying myself. The majority of my presentation was suggestions on how the network in general could be improved and a inside look into the difficulties in performing the test. Its not every penetration test where you have switch cars and check into hotels under false names to avoid the media.

    Soumushou, Nagano, the Japanese auditors I performed the test with and a group of lawyers were given the contents of my presentation one month before the conference. The issue is, one hour before my presentation Soumushou told the Japanese organizers (who are government contractors) to cancel my event because they didnt want me talk about Juki. And herein lies the problem.

    My website is down now but the facts of the events that have occured are all available online. Hope this helps to clarify things.

    English Translation of Press Conference Announcement
    I have decided to sue Japan. I arrived in Japan expecting to make a short presentation, see some old friends and meet my business contacts. Three weeks later and the rest is history.

    PRESS CONFERENCE ANNOUNCE

    Nov. 19, 2004

    Announce a press conference on Nov 22, 2004 for Mr. Ejovi Nuwere filing a trial in Japan on the following issue.

    Mr. Ejovi Nuwere was a invited speaker for an international seminar of computer security specialists held on Nov 12, 2004. Mr. Nuwere was planning a presentation on Jukinet (Basic Resident Registry Network) security findings and recommendations based on his experence of last year when he was hired for penetration testing of several local government locations in Nagano Prefecture. However, right before the schedule of presentation, the Ministry of Internal Affairs and Communications (MIAC) had intervened him through Japanese organizer of the event, demanded him to change the presentation content drastically. As the result, his talk was canceled.

    This conduct of MIAC is an injustice that is not suitable to an agency of the country which aims to be a leading IT developed nation. It was unacceptable act by any measure especially for Mr. Nuwere who was a security specialist and was planning to present recommendations to improve security of Jukinet. Given this factor, Mr. Nuwere decided to address the problem by filing a suit against MIAC. The suit is aiming to prevent repeatitive occurance of the injustice by public power in Japan.

    We will hold a press conference about this trial on Nov 22, 2004, from 2:00pm to 3:00pm, announcing to file a petition based on violation of freedom of speech. We encourage you to attend for your news report.

    Ejovi Nuwere (イジョビ・ヌゥワァー)氏の11月22日提訴発表についてご案内します

     Ejovi Nuwere氏は、2004年11月12日に東京都内で開催されたコンピュータセキュリティ専門家の国際セミナーにおいて、来日中の同氏が2003年秋に携わった長野県内自治体での住基ネット侵入実験の発見事項と改善への所見を発表することになっていました。しかし、発表直前になり総務省より発表内容の大幅な変更の要求が日本側主催者を通じてあり、発表そのものが実現できなくなりました。
    今回の総務省のこのような対応は、およそIT国家を目指している国の機関とは思えない不当行為であり、特に住基ネットのセキュリティ改善への推薦事項を述べようとしていたセキュリティ専門家としては到底容認できるものではありません。そこでNuwere氏は、本提訴により、日本において今後このような公権力による妨害行為が繰り返されないよう、裁判で問題を明らかにすることにいたしました。

    11月22日、東京地方裁判所にて表現の自由の侵害に基づく損害賠償請求の訴訟を提起します。

    For some reason my server has gone down... Since I am in Japan it will be awhile before Ican resolve whatever issue there maybe. The best way to contact me for now will be ejovin@gmail.com. A IDG News article was published about Soumushou censoring my speech...

    I would like to clarify:
    Soumushou claims that they were suprised that my talk was canceled, I guess this is just politics as usual for them. As I said before,I was given the option of canceling my talk or using one month old slides with the LAST THREE slides, from conclusion on removed...it was not a choice of using my presentation slides minus one slide named "conclusion."

    Most importantly, I offered to do the presentation without slides and they rejected this too. So, as I said earlier, if they have a problem with only one slide, and not the entire presentation then they would have had no problem allowing me to present without slides.

    To anyone that was at the conference, it was very clear that Soumushou did not want me to talk, as Dragos Ruiu the conference organizer said in the IDG article "'It seems that they (the MIC) never wanted the presentation to be made,' Ruiu said."
